# Terms of Use

## 1. Agreement to Terms

By downloading, installing or using YDS Hazırlık (the "App"), you agree to be bound by these Terms of Use (the "Terms"). If you do not agree, please do not use the App.

## 2. Who We Are

The App is provided by Burhan Karakurt ("we," "us," or "our").

## 3. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App strictly in accordance with these Terms. You may use the App for personal, non-commercial purposes to prepare for the YDS (Foreign Language Proficiency Exam) and improve your English language skills.

## 4. User Accounts & Registration

To use certain features you may be required to register an account. You must provide accurate and complete information including:

- Email address

- Name

- Password

You are responsible for:

- Maintaining the confidentiality of your account credentials

- All activities that occur under your account

- Notifying us immediately of any unauthorized use

The App is intended for users aged 13 and above. If you are under 18, you should have parental or guardian consent to use the App.

## 5. User Conduct

You agree not to:

- Use the App in any way that violates applicable laws or regulations

- Reverse engineer, decompile or disassemble the App

- Share your account credentials with others

- Use automated tools or bots to access the App

- Attempt to gain unauthorized access to any portion of the App

- Interfere with the security, performance or functionality of the App

- Upload or share any content that is unlawful, abusive, harassing, hateful, defamatory or otherwise objectionable

- Use the App to cheat on actual YDS examinations

## 6. Intellectual Property

All intellectual property rights in the App, including but not limited to:

- Software and source code

- Graphics, logos, and design elements

- Question banks and educational content

- Story content and reading materials

- Audio pronunciations and listening materials

- Vocabulary databases

- User interface and experience design

belong to us or our licensors. You acquire no rights other than the license to use as set out in Section 3.

## 7. User-Generated Content

The App may allow you to:

- Track your progress and statistics

- Create study notes

- Mark favorite words and questions

- Submit feedback

You retain ownership of your User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, publish and distribute such User Content in connection with the App's operation and improvement.

We have the right (but not obligation) to monitor, refuse to post, or remove any User Content for any reason.

## 8. Payment & Subscriptions

The App offers premium features through subscription plans:

### Payment Terms:

- You agree to pay all fees as specified at the time you subscribe

- Payments are processed through Apple App Store (iOS) or Google Play Store (Android)

- You agree to the payment provider's terms and conditions

- Subscription fees are charged at the beginning of each billing period

- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period

### Cancellation & Refunds:

- You may cancel your subscription at any time through your App Store or Play Store account settings

- Cancellation takes effect at the end of the current billing period

- No refunds will be provided for partial subscription periods, except where required by law

- If you believe you were incorrectly charged, please contact us within 14 days

### Free Trial (if applicable):

- Free trial periods, if offered, are available only once per user

- You will be charged when the trial period ends unless you cancel before that time

## 9. Educational Content Disclaimer

The App provides educational content to help users prepare for the YDS examination. However:

- We do not guarantee specific exam results or scores

- The content is for educational purposes only and should not be considered official YDS material

- Actual YDS exam content may differ from practice materials in the App

- We are not affiliated with or endorsed by ÖSYM or any official YDS examination body

- Users are responsible for verifying official exam requirements and procedures

## 10. Data & Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the App, you consent to our data practices as described in the Privacy Policy.

## 11. Termination

We may suspend or terminate your access to the App at any time, without prior notice, for conduct that:

- Violates these Terms

- Is harmful to other users, the App, or us

- Involves fraudulent or illegal activity

- Abuses or exploits the App's features

Upon termination:

- The license granted in Section 3 ends immediately

- You must stop using the App

- We may delete your account and associated data

- Active subscriptions may be cancelled without refund (except where required by law)

You may terminate your account at any time by contacting us or deleting the App.

## 12. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, including but not limited to:

- Fitness for a particular purpose

- Non-infringement of third-party rights

- Uninterrupted or error-free access

- Accuracy or completeness of educational content

- Achievement of specific learning outcomes or exam scores

We do not warrant that:

- The App will meet your requirements

- The App will be available at all times

- Defects will be corrected

- The App is free of viruses or harmful components

## 13. Limitation of Liability

To the fullest extent permitted by law, neither we nor our officers, directors, employees, partners or agents will be liable for any:

- Indirect, incidental, special, consequential or punitive damages

- Loss of profits, revenue, data or use

- Damages arising from your use or inability to use the App

- Damages resulting from unauthorized access to your account

- Damages from errors, mistakes or inaccuracies in content

Our total aggregate liability is limited to the amount you paid (if any) for the App in the 12 months preceding the claim, or ₺500 TRY, whichever is less.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you.

## 14. Indemnification

You agree to indemnify, defend and hold harmless us and our affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs or expenses (including reasonable attorneys' fees) arising out of or relating to:

- Your use of the App

- Your violation of these Terms

- Your violation of any rights of another party

- Your User Content

## 15. Third-Party Services

The App may contain links to third-party websites, services or resources. We are not responsible for:

- The availability or accuracy of such external sites

- The content, products or services available from such sites

- Any damages or losses caused by your use of third-party services

Your use of third-party services is at your own risk and subject to their terms and conditions.

## 16. Updates & Modifications

We may:

- Update, modify or discontinue any feature of the App at any time

- Perform maintenance that temporarily restricts access

- Change subscription prices for new subscribers (existing subscriptions maintain their original price until renewal)

We will make reasonable efforts to notify you of significant changes.

## 17. Governing Law & Dispute Resolution

These Terms will be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.

Before filing any legal claim, you agree to first contact us to attempt to resolve the dispute informally.

## 18. Changes to Terms

We may modify these Terms from time to time. We will notify you of significant changes by:

- Posting a notice in the App

- Sending an email to your registered email address

- Displaying a notification when you open the App

Your continued use of the App after changes means you accept the new Terms. If you do not agree to the modified Terms, you must stop using the App.

The "Last Updated" date at the top of this document indicates when the Terms were last revised.

## 19. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of law, the remaining provisions will continue in full force and effect.

## 20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App and supersede any prior agreements.
